Abstract

Penelitian ini bertujuan untuk menguji faktor-faktor yang mempengaruhi ketidakpatuhan upah minimum pada UMKM ritel di Kota Kupang. Faktor-fator yang dianalisis adalah peran ambiguitas regulasi, hubungan paternalistik, dan kapasitas pengawasan. Data dikumpulkan dari 515 pelaku UMKM. Data dianalisis dengan metode SEM-PLS. Hasilnya menunjukkan kapasitas pengawasan memiliki pengaruh paling kuat. Lemahnya pengawasan langsung berkontribusi pada ketidakpatuhan pengupahan. Regulasi yang ambigu juga memperparah masalah ini. Hubungan paternalistik antara pemilik dan karyawan memiliki pengaruh kecil, tetapi signifikan. Ketiga faktor ini bersama-sama menjelaskan 46,5% dari ketidakpatuhan dalam pengupahan. Temuan ini memberikan peta jalan untuk intervensi. Perbaikan sistem pengawasan akan memberikan dampak paling besar. Penyederhanaan regulasi upah juga diperlukan untuk meningkatkan kepatuhan.
